1. Agreement to Terms

By accessing and using CapsuleCove, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use of Service

CapsuleCove provides a digital marketplace for gachapon-style merchandise. By using our service, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and accept all risks of unauthorized access
• Not use the service for any illegal or unauthorized purpose
• Not transmit any viruses, malware, or other malicious code
• Not interfere with or disrupt the service or servers
• Comply with all applicable local, state, national, and international laws and regulations

3. Account Registration

To access certain features of the service, you must register for an account. You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. CapsuleCove reserves the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

4. Purchases and Payments

When making purchases on CapsuleCove:

• All purchases are processed through our secure payment provider, Stripe
• You agree to pay all charges at the prices in effect when you place your order
• We reserve the right to refuse or cancel orders at any time for reasons including product availability, errors in pricing or product information, or suspected fraud
• All sales are final unless otherwise stated
• Credit balances are non-refundable and non-transferable

5. Gachapon Mechanics

Understanding how our gachapon system works:

• Each roll results in one randomly selected item from the available prize pool
• All randomization is server-verified to ensure fairness
• Every roll guarantees a physical prize - there are no "empty" results
• The specific item received is determined randomly and cannot be selected by the buyer
• Once a roll is completed, it cannot be reversed or refunded

6. Seller Responsibilities

If you are a creator/seller on CapsuleCove, you agree to:

• Provide accurate descriptions and images of all items
• Maintain adequate inventory of listed items
• Fulfill orders in a timely manner
• Ship items securely and provide tracking information
• Comply with all applicable laws regarding the sale and shipment of goods
• Not sell counterfeit, stolen, or illegal items
• Pay all applicable fees and commissions

7. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of CapsuleCove. The service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without prior written consent. Sellers retain ownership of their content but grant CapsuleCove a license to display and promote their items.

8. Prohibited Activities

You may not:

• Use the service for fraudulent purposes or in connection with criminal activity
• Attempt to manipulate the randomization system or exploit the platform
• Create multiple accounts to circumvent restrictions
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Scrape or copy content without permission

9. Shipping and Delivery

Sellers are responsible for shipping purchased items. Estimated delivery times are provided by sellers but are not guaranteed. CapsuleCove is not responsible for shipping delays, lost packages, or customs issues. Buyers should contact sellers directly regarding shipping concerns.

10. Limitation of Liability

In no event shall CapsuleCove, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

11. Disclaimer

Your use of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. CapsuleCove makes no warranties, expressed or implied, regarding the service, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Dispute Resolution

Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration in accordance with the applicable arbitration rules. You waive any right to a jury trial or to participate in a class action lawsuit.

13. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease.

14. Changes to Terms

We reserve the right to modify or replace these terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after revisions become effective, you agree to be bound by the revised terms.

15. Governing Law

These terms shall be governed and construed in accordance with the laws of the jurisdiction in which CapsuleCove operates, without regard to its conflict of law provisions.
